1. Who we are

Étude Pilates ("Étude", "we", "us", "our") is operated by The Active Healer LLC, a company registered in the SHAMS free zone, United Arab Emirates ("the Company"). You can reach us at hello@etudepilates.com.

By creating an account or using Étude, you agree to these Terms. If you do not agree, please do not use the service.

2. What Étude is, and what it is not

Étude is a class-planning tool for qualified movement professionals. It generates Pilates class sequences and provides repertoire, cueing, and load suggestions to help you build classes more quickly. The Étude library currently contains 551 exercises across Reformer, Mat, Tower, and Chair (222 Reformer, 113 Mat, 112 Tower, 104 Chair).

Étude is a planning aid. It is not a substitute for your own training, assessment, or professional judgement, and it does not provide medical advice. All spring loads, levels, repertoire choices, cues, and prenatal or injury flags are starting points, not prescriptions or clinical clearance. You are solely responsible for assessing each client, setting and testing loads, and adapting or omitting any exercise as the body in front of you requires. 3. Eligibility

You must be at least 18 years old and a qualified or training movement professional to use Étude. By using the service you confirm that you hold, or are working toward, the relevant qualifications and insurance to teach the modalities you build classes for.

4. Your account

You are responsible for keeping your login details secure and for all activity under your account. Tell us promptly at hello@etudepilates.com if you believe your account has been accessed without your permission. You must give accurate account information and keep it current.

5. Subscriptions, billing, and renewals

Some features require a paid subscription. Plan names, features, and prices are shown in the app at the point of purchase. Unless stated otherwise, paid plans renew automatically for the same period until you cancel. We may change prices or plan features, and we will give reasonable notice before a change affects you. Payment is processed by our payment provider; your use of paid plans is also subject to that provider's terms.

6. Cancellation and refunds

You can cancel your subscription at any time from your account, and cancellation stops all future renewals. We do not refund partial periods. If you cancel partway through a billing period, your Pro access continues until the end of the period you have paid for, and that period is not refunded. 7. Acceptable use

You may use Étude only for your own class planning and teaching. You may not: resell, redistribute, publish, or share the Étude content library or generated sequences as a competing product or content pack; scrape, copy, or bulk-export the library; share one account across multiple instructors outside a plan that allows it; or use the service in any unlawful way.

8. Intellectual property

The Étude platform, its content library, sequencing logic, branding, and design are owned by the Company and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to use them for your own teaching while your account is active. You keep ownership of the content you add, such as your client records and notes ("Your Content"). You grant us a licence to host and process Your Content only as needed to provide the service.

9. Your clients and their data

If you enter information about your clients, you are responsible for having a lawful basis and any necessary consent to do so, and for handling that information in line with applicable privacy law. You act as the controller of your client information; we process it on your behalf to provide the service. See our Privacy Policy at https://etudepilates.com/privacy.

10. Professional responsibility and disclaimer

You acknowledge that you use Étude as a qualified professional exercising your own judgement. To the extent permitted by law, the Company is not responsible for how you apply, adapt, or teach any sequence, load, or cue generated or suggested by the service, or for any outcome experienced by you or your clients.

11. Limitation of liability

To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind. The Company will not be liable for any indirect, incidental, special, or consequential loss, or for any loss of profit, data, or goodwill. Where liability cannot be excluded, our total liability to you is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

12. Indemnity

You agree to indemnify the Company against claims, losses, and costs arising from your use of the service, your breach of these Terms, or your handling of your clients or their data.

13. Suspension and termination

You may stop using Étude and close your account at any time. We may suspend or end your access if you breach these Terms or use the service in a way that risks harm to others or to the service. On termination, your licence to use the Étude content ends.

14. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will give reasonable notice in the app or by email. Continuing to use Étude after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the United Arab Emirates as applied in the [Abu Dhabi / relevant emirate] and the SHAMS free zone, and you agree to the jurisdiction of its courts.
